Outside of states with online poker, most other US jurisdictions don’t have laws in place explicitly making online poker illegal. Indiana is an exception, as online gambling in the Hoosier State is expressly outlawed. State-regulated online sports betting sites operate legally in Indiana, but any kind of online gambling outside of those legal. In most cases, general state gambling laws make online poker illegal as well. To our knowledge, no one in the United States has been indicted or convicted of a crime related to playing online poker for money so far. This, of course, might change in the blink of an eye.
The simple answer is: yes, online poker is legal.
Online poker has a tumultuous history in the United States, but things are looking up. Four states, Nevada, New Jersey, Pennsylvania and Delaware all legalized online poker and sites are up and running in each of those states. Others like Michigan and West Virginia legalized online poker and are working on launching sites soon.
Several other states are in the process of legalizing it too. This is a big 180 from where poker was a decade ago.
In 2006, the Unlawful Internet Gambling Enforcement Act passed in the United States, making it illegal for U.S. banks to do business with online gaming sites. Some sites left, others stayed. Then in 2011 The Department of Justice seized the domains of major poker sites for charges that included bank fraud and money laundering.
After that, online poker pretty much vanished from the United States until a federal judge ruled in 2012 that poker was a game of skill, not luck. This paved the way for Nevada to open up the first state-regulated online poker site and several states followed.
The floodgates really opened up after the Supreme Court struck down a ban on sports betting, letting states regulate it as they see fit. Many states have taken the opportunity to address online poker along with sports betting.
Where can I play Online Poker in the United States?
That depends on where you are. There are several different poker sites out there, some serve the entire United States while others are specific to each state.
If you’re in Nevada, New Jersey, Delaware or Pennsylvania, you have access to a few extra state-specific sites. PokerStars is live in New Jersey and Pennsylvania and you can play WSOP Online in Nevada and Delaware. These sites have partnered up with local casinos to offer online poker and you have to be within state lines to play. New Jersey, Nevada and Delaware have share player pools though. That means players from all three states play against each other.
More states are legalizing online poker, so this list will grow. We’ll keep it up to date as more sites launch in different states.
But a few sites accept players from all 50 states.

Didn’t the U.S. Ban Online Poker in 2006?
No.
A lot of sites did pull out of the United States after it passed though. The 2006 UIGEA made it illegal for banks and financial institutions to process payments linked to online gambling. The law was a little ambiguous though and there was nothing explicitly banning poker.
Some big sites, like Party Poker, pulled out of the United States, but other giants like PokerStars and Full Tilt stayed in the country. To process payouts for U.S. players, these sites had to break the law. Then, in April 2011, the Department of Justice seized the sites’ domain names and indicted a few key people on charges of money laundering, bank fraud and more.
Absolute Poker imploded, Full Tilt almost went bankrupt. PokerStars, on the other hand, paid the fine, bailed out Full Tilt and is now back in the United States.
New State Laws Regarding Online Poker
After a federal judge ruled that poker was a game of skill, not chance, Nevada took the first step to legalize online poker. The state paved the way for others to do the same. Delaware followed and also legalized lottery and casino games. New Jersey did all of this on an even larger scale. The latest to join the group was Pennsylvania, which passed its law in 2017 and finally launched regulated online poker in late 2019.
Michigan has passed online poker legislation but won’t launch until late 2020 at the earliest. West Virginia also legalized online poker and sites won’t be too far behind.
All these states have sites that are linked with land-based casinos. Several other casinos are developing sites too. We’ll see more develop as online sites keeps gaining popularity. The big question now is whether sites will share their player pools.
New Jersey, Delaware and Nevada have all signed up to share their player pool. Pennsylvania is the most populous state to legalize online poker, but it has yet to join the pool. A joint pool would be critical to creating large tournaments, a wide selection of cash games and a healthy poker ecosystem.

The Wire Act
The first one is the Interstate Wire Act of 1961, often called the Federal Wire Act. As you can see, it passed long before online poker or even the internet existed. However, it prohibits certain types of betting businesses to operate via wired communications.
In 2011, the US Department of Justice concluded that the scope of the act was limited to sporting events. Therefore, states, where online poker is now regulated, found that the bill didn’t apply to online poker nor other forms of gambling.
However, in 2019, the US Department of Justice reversed its opinion. The new opinion concludes that the Wire Act applies to all types of online gambling.
The UIGEA
The other relevant law is the Unlawful Internet Gambling Enforcement Act (UIGEA) from 2006. This law made it illegal for US banks to proceed with transactions for offshore gambling companies. That’s how they were pushed out of the market.
History of US Legal Online Poker
Online casinos started to appear back in 1994. They were usually situated in Antigua or the Isle of Man. However, the vast majority of their users were US-based customers. Two years later, in 1996, online gambling was also brought to the North American market soil.
The Kahnawake Gaming Commission was established just outside Montreal. They started issuing licenses, and pretty soon, it was possible to find hundreds of new online gambling websites.
Once again, two years later and again in Canada, the first-ever poker online website saw the light of day. Planet Poker was the favorite source of fun to thousands of Americans who were spending endless hours playing the first real-money online Texas Hold’em.
Over the next few years, thanks to technological advances, better online poker software was developed, while the number of websites kept increasing. These online poker operators also started to offer various tournaments and cash games and got a solid fan base all over the world.
Legal Us Poker Sites
The Industry Kept Growing & Then It Collapsed
Even though there were different interpretations of the law, especially of the famous Wire Act, the newly developed industry kept growing.
The year 2003 is especially important in the evolution of online poker. Using an account from Tennessee, Chris Moneymaker won the World Series of Poker after participating in the event through an online satellite. In Chris Moneymaker's case, we guess, it's okay to say that name determines destiny.
This online poker strategy was live-streamed on ESPN. Suddenly, the whole nation knew about Chris's story. A good number of Americans were hoping to be the next. All of a sudden, poker was everywhere on TV. Live games were followed carefully, and commercial breaks had one purpose: promoting online poker for money and playing Texas Hold 'em online.
The great number of promoted sites were, in fact, offshore online poker sites. A lot of them disappeared from American browsers after Congress passed the above-mentioned UIGEA in 2006.
However, even though a lot of sites weren't accessible anymore, online poker couldn't be erased that easily. Some of the offshore gambling companies had found a way around the Unlawful Internet Gambling Enforcement Act of 2006, but not for long.
In 2011, some of the largest online poker operators, including PokerStars, Full Tilt Poker, and Absolute Poker/Ultimate Bet, were accused of violating UIGEA and money laundering. These websites were definitely excluded from the significant US online poker market, which seemed to come to an end at the time.
Legal Online Poker Sites Rise Again
Also in 2011, the DOJ released a legal opinion that the Federal Wire act exclusively applied only to one form of gambling: sports betting. A few states saw this as a possibility, paving the way to regulated online casinos and legal US poker sites.
In 2012, Delaware was the first state that managed to do just that. Then, in December 2013, Nevada followed the example of passing online poker legislation. A week later, the Garden State became the third to legalize online gambling, and plans for NJ poker sites were made.
The first-ever regulated US online poker site was launched in Nevada in April 2013. Delaware and NJ poker sites went live that same year, a few months later. In 2017, Pennsylvania became the fourth state to join this group. West Virginia is the fifth state where online poker was regulated in 2019. Probably, more states will try to do the same thing in the near future.
